Privacy Notice on the Protection of Personal Data

1. Introduction

Our company attaches importance to the protection of personal data in all its activities and regards it as one of its priorities in its business and operations. Our company's Policy on the Protection and Processing of Personal Data (the “Policy”) is the fundamental regulation for bringing our company's organisation and business processes into line with the procedures and principles for processing personal data laid down by Personal Data Protection Law No. 6698 (“KVKK”). In line with the principles of this Policy, our company processes and protects personal data with a high degree of responsibility and awareness, and ensures the necessary transparency by informing data subjects.

2. Purpose

This privacy notice has been prepared pursuant to Article 10 of Personal Data Protection Law No. 6698 (“KVKK”) in order to inform data subjects about the processing of personal data collected by our company as a legal entity and at its service centres.

3. Scope

Under the KVKK, personal data means any information relating to an identified or identifiable natural person. Under the provisions of the KVKK, the person or organisation that determines the purposes and means of processing personal data and that establishes and manages the data filing system is called the data controller. Within this framework, our company is the “Data Controller” for road passenger transport and for the ticket listing, journey display, ticket reservation, sales and similar services we provide through all our platforms, including our website and mobile application. In order to carry out the activities described above, our company will process your personal data as data controller within the scope, for the purposes and on the legal grounds explained below. If you have any questions about this Privacy Notice, please contact us through the communication channels given at the end of this text.

4. Methods of Collecting Personal Data and Legal Grounds

Ensuring the security of personal data is one of our primary objectives. As data controller, and within the framework of our legal obligations arising from the legislation, our company collects your personal data for purposes such as enabling you to benefit from our brand's services, informing you about our campaigns if you consent, recording your suggestions and complaints, establishing better service standards for you, and determining and implementing our company's commercial and business strategies. Your personal data are collected with the consent of you, our customers, and in accordance with the provisions of the legislation, through our physical agencies, our platforms, cookies, social media accounts, authorised agencies, service providers, intermediary service providers, communication channels on the platform, notifications from administrative and judicial authorities, and other websites, mobile applications and similar means, by visual, audio, physical, verbal, written or electronic methods.

When you interact with us through our company's social media accounts, the personal data you have provided to the social media platform concerned may also be processed. We would also like to point out that the use of social media platforms, and the content and features provided on them, are subject to that platform's own privacy and usage policies.

We use identifiers (cookies) to help personalise your online experience and to allow you to sign in to our services. Personal data may be collected on the platform through cookies for different purposes. Cookies are small text files that store small pieces of information. They are stored on your device or on the network server, through your browser, by the websites you visit. They are widely used on almost all websites so that websites work effectively and in line with visitors' preferences, and also to provide information to website operators. We use cookies so that our website can be used as efficiently as possible and, in this context, to improve the functionality and performance of our website, to develop the services offered to our visitors, to introduce new features and personalise them according to our visitors' preferences, and to ensure the legal and commercial security of our website and our visitors. Many web browsers are set to accept cookies automatically by default. If you do not want these tools to be used, you can delete or block them in your browser settings. However, please note that in this case the performance of our website may be affected and you may not be able to use all of the website's functions in full. 5. Purposes of Processing Personal Data

Under the KVKK, as a rule, personal data may not be processed without the explicit consent of the data subject. Our company processes your personal data by the methods set out in section 4, in the cases and to the extent permitted by the legislation. Within this framework, the purposes for which your personal data are processed are as follows:

to verify the identity details of the person buying a ticket through our platforms and of the person for whom the ticket is bought;
to record addresses and other information needed for communication;
to carry out the processes for concluding and performing contracts;
to contact our customers about the terms, current status and updates of the contracts we conclude under the distance sales contract and the relevant articles of the Law on Consumer Protection, to provide the necessary information, and to fulfil the obligations undertaken under the contracts we conclude;
to prepare all records and documents, in electronic or paper form, that will form the basis of transactions;
to provide information to public officials on matters of public security when requested and as required by the legislation;
to provide a better service to our customers, to inform our customers about products they may be interested in, taking their interests into account, and to pass on campaigns;
to inform our customers by email or text message within the framework of the Law on the Regulation of Electronic Commerce and the related legislation;
to increase customer satisfaction, to get to know our customers through our platforms and use this in customer base analysis, to use it in various marketing and advertising activities and, in this context, to conduct surveys electronically and/or in person through contracted organisations;
to enable our contracted institutions and solution partners to make offers to our customers, and to inform our customers about our services;
to assess customer complaints and suggestions about our services;
to carry out goods and service production, operation and sales processes, finance and accounting activities, and archiving activities;
to ensure information security;
to fulfil our legal obligations and to exercise our rights arising from the legislation in force; and they are processed only in accordance with the provisions of the KVKK.

3. Your Personal Data That We Process

The personal data we process may vary depending on the nature of the legal relationship you have established with our company. In general, however, the personal data we process are as follows:

Identity Information: your personal data such as your first name, surname, identity details, date of birth, driving licence details, passport number and nationality that you provide when becoming a member of the Platform; when searching for, buying or reserving tickets and using similar services on the Platform or at our physical agencies; in conversations through live support or the call centre; and in all your applications.

Contact Information: your personal data such as your email address, telephone number, mobile phone number, social media contact details and address that you provide when becoming a member of the Platform; when searching for, buying or reserving tickets and using similar services on the Platform or at our physical agencies; in conversations through live support or the call centre; and in all your applications.

Customer Information: your personal data such as first name, surname, nationality, date of birth, Turkish ID number, passport number, gender, reservation details, purchase details, invoice details, delivery details, travel details, travel dates and customer transaction details; API/PNR numbers; call centre records, credit card statements, ticket office receipts, customer instructions and records kept in the related channels; information and records collected in connection with requests and complaints, and their outcomes; and the website passwords you create while using our services offered in digital environments.

Financial Information: credit/debit card details, bank account details, IBAN, balance information, credit balance and other financial information.

Sensitive Data: necessary information about your state of health that may affect the service you receive, and disability information, processed where expressly provided for in the legislation and necessary for our operations, and with your explicit consent.

Marketing Information: reports showing the preferences of the person, to be used for marketing purposes; targeting information; cookie records; information derived through data enrichment activities; and information and evaluations obtained from surveys, campaigns and direct marketing activities.

Transaction Security Information: transaction security information.

Other Information: information about family members and relatives (identity and contact details of the data subjects' children and spouses), physical premises security information (entry and exit records, visit information, photographs, camera and audio recordings), and legal transaction and compliance information (requests for information from judicial and administrative authorities, etc.).

5. Our Company's Rights and Obligations Under the Law

In accordance with Article 20 of the Constitution and Article 4 of the KVKK, our company processes personal data:

lawfully and fairly;
accurately and, where necessary, keeping them up to date;
for specified, explicit and legitimate purposes;
in a way that is relevant to the purposes of processing;
in a limited and proportionate manner;

and retains them for the period laid down by law or required by the purpose of processing. Personal data are processed and transferred on the basis of the conditions set out in Articles 5 and 6 of the KVKK.

All data received through the Platform are transferred from your computer or mobile device to our application servers using a 256-bit RSA SSL certificate compliant with the TLS 1.2 standard. Your payment details are kept in the database on our application servers in accordance with the law.
Penetration tests are carried out at regular intervals to test the system's resistance to unauthorised access.
Access authorisation and control matrices have been set up for employees to prevent personal data collected through the Platform from being processed unlawfully.

Since, under Article 4 of the KVKK, our company is obliged to keep the personal data of data subjects accurate and up to date, our customers need to share accurate and up-to-date data with us so that we can fulfil this obligation. If your personal data change in any way, please update your details by visiting your profile page.

The Platform Owner retains the personal data it processes for the periods laid down by the legislation. Where no period is laid down in the legislation, personal data are retained for as long as their processing is required under our company's practices and the customs of commercial life in connection with the services we provide when processing the personal data concerned, and after that only for the periods shown to be necessary in practice, for the purpose of serving as evidence in possible legal disputes. After these periods expire, the personal data concerned are deleted, destroyed or anonymised.

6. Transfer of Personal Data

Personal data are shared with third parties within the framework of the legislation in force and/or the explicit consent given by the data subjects. In addition, because of our legal obligations, and limited to them, personal data are shared with courts and other public institutions. Personal data are also transferred to third parties within a contractual relationship so that we can provide the services we have undertaken and carry out quality control of the services provided.

The necessary technical and administrative measures are taken to prevent data breaches when data are transferred to third parties.

Your personal data may be shared with the programme partner institutions and organisations we work with to carry out our activities; with authorised agencies; with third parties acting as service providers and/or intermediary service providers; with our business partners providing special integrator services; with third parties providing independent audit services; with persons and institutions in Türkiye or abroad from which we obtain cloud data storage services; with organisations in Türkiye or abroad with which we have agreements for sending commercial electronic messages to our customers; with our financial advisers; with the Interbank Card Centre; with the banks with which we have agreements; with payment service providers; within the scope of various marketing activities, with various agencies, advertising companies and survey companies in Türkiye and abroad, so that we can serve you better and ensure customer satisfaction; with other third parties in Türkiye or abroad and our related business partners, shareholders and affiliates; and with third parties from which we obtain services under a contractual relationship, our lawyers, our consultants and legally authorised public institutions and private legal entities.

7. Rights of the Data Subject

Under Article 11 of the KVKK, data subjects have the right:

to learn whether their personal data are processed;
to request information about the processing if their personal data have been processed;
to learn the purpose of processing their personal data and whether the data are used in line with that purpose;
to know the third parties in Türkiye or abroad to whom their personal data are transferred;
to request the correction of their personal data if they have been processed incompletely or inaccurately;
to request the deletion or destruction of their personal data under the conditions set out in Article 7 of the Law;
to request that the actions taken under items 5 and 6 be notified to the third parties to whom their personal data have been transferred;
to object to a result against them arising from the analysis of the processed data exclusively by automated systems;
to claim compensation for damage if they suffer damage because their personal data have been processed unlawfully.

Where data subjects apply to our company in writing, or by other methods to be determined by the Personal Data Protection Board, to exercise these rights in accordance with Article 13 of the KVKK, applications are concluded as soon as possible depending on the nature of the request, and in any case within 30 days at the latest. To exercise your rights under the KVKK, you can send a signed, detailed statement setting out your identity, address and contact details, the right you wish to exercise and the subject of your request to the address and contact details given below.

Kişisel Verilerin Korunmasına İlişkin
Aydınlatma Metni
1. Giriş
Firmamız yürüttüğü faaliyetlerde kişisel verilerin korunmasına önem vermekte ve iş ve işlemlerinde öncelikleri arasında kabul etmektedir. Firmamız, Kişisel Verilerin Korunması ve İşlenmesi Politikası (“Politika”), 6698 sayılı Kişisel Verilerin Korunması Kanunu’nca (“KVKK”) belirlenen kişisel veri işleme usul ve esaslarının firmamız organizasyon ve iş süreçlerinin uyumuna yönelik temel düzenlemedir. Firmamız, bu Politika prensipleri doğrultusunda, üst düzey sorumluluk ve bilinciyle kişisel verileri işlemekte ve korumakta, kişisel veri sahiplerini bilgilendirerek gerekli şeffaflığı sağlamaktadır.
2. Amaç
İşbu aydınlatma metni, 6698 sayılı Kişisel Verilerin Korunması Kanununun (“KVKK”) 10. maddesi uyarınca, Firmamız tüzel kişiliği ve hizmet merkezlerinde toplanan kişisel verilerin işlenmesine ilişkin ilgili kişilerin aydınlatılması amacı ile hazırlanmıştır.
3. Kapsam
KVKK kapsamında kişisel veri, kimliği belirli ya da belirlenebilir bir kişiye ait her türlü bilgi anlamına gelir. KVKK hükümlerine göre, kişisel verilerin işlenme amaçlarını ve yöntemlerini belirleyen, veri kayıt sistemini kurup yöneten kişi veya kuruluş, veri sorumlusu olarak adlandırılır. Bu çerçevede, firmamız, karayolu yolcu taşımacılığı ve internet sitesi ile mobil uygulamamız dahil olmak üzere tüm platformlarımız üzerinden sunduğumuz bilet listeleme, sefer görüntüleme, bilet rezervasyonu, satış ve benzeri hizmetler için "Veri Sorumlusu" konumundadır. Firmamız, yukarıda belirtilen faaliyetleri yerine getirebilmek amacıyla, kişisel verilerinizi veri sorumlusu olarak aşağıda açıklanan kapsam, amaçlar ve yasal gerekçeler doğrultusunda işleyecektir. Bu Aydınlatma Metni ile ilgili herhangi bir sorunuz olması halinde, metnin sonunda belirtilen iletişim kanalları aracılığıyla bizimle irtibata geçmenizi rica ederiz.
4. Kişisel Verileri Toplama Yöntemleri ve Yasal Dayanaklar

Kişisel verilerin güvenliğinin sağlanması öncelikli hedeflerimizdendir. Firmamız, veri sorumlusu sıfatıyla, mevzuattan kaynaklanan yasal yükümlülüklerimiz çerçevesinde; markamızın hizmetlerinden faydalanabilmeniz, onayınız halinde kampanyalarımız hakkında sizleri bilgilendirmek, öneri ve şikayetlerinizi kayıt altına alabilmek, sizlere daha iyi hizmet standartları oluşturabilmek, Firmamız ticari ve iş stratejilerinin belirlenmesi ve uygulanması gibi amaçlarla kişisel verilerinizi siz müşterilerimizin rızaları ve mevzuat hükümleri uyarınca fiziki acentelerimiz, platformlarımız, çerezler, sosyal medya hesapları, yetkili acenteler, hizmet sağlayıcıları, aracı hizmet sağlayıcıları, platform üzerindeki iletişim kanalları, idari ve adli makamlardan gelen tebligatlar ve sair internet sitesi, mobil uygulamalar ve benzeri vasıtalarla ; görsel, işitsel, fiziksel, sözlü, yazılı veya elektronik yöntemlerle toplanmaktadır.
Firmamıza ait sosyal medya platformları üzerinden bizlerle etkileşime geçtiğinizde, ilgili sosyal medya platformuna sağladığınız kişisel verileriniz de işlenebilmektedir. Bununla birlikte, sosyal medya platformlarının kullanımının, sağlanan içeriklerin ve özelliklerin, ilgili platformun kendi gizlilik ve kullanım politikalarına tabi olduğunu belirtmek isteriz.
Çevrimiçi deneyiminizi kişiselleştirmenize yardımcı olmak ve hizmetlerimizde oturum açabilmenizi sağlamak için “tanımlama bilgileri” (çerez veya cookie) kullanır. Platform üzerinden çerezler aracılığıyla farklı amaçlar doğrultusunda kişisel veriler toplanabilmektedir. Çerezler, küçük bilgileri saklayan küçük metin dosyalarıdır. Çerezler, ziyaret edilen internet siteleri tarafından, tarayıcılar aracılığıyla cihazınıza veya ağ sunucusuna depolanır. İnternet sitelerinin etkin bir şekilde ve ziyaretçilerin tercihlerine yönelik çalışması ve ayrıca internet sitesinin yöneticilerine bilgi imkanı sağlaması amacıyla, neredeyse tüm internet sitelerinde yaygın şekilde kullanılmaktadır. Çerezleri, internet sitemizden en verimli şekilde faydalanılması, bu kapsamda internet sitemizin işlevselliğinin ve performansının arttırılması, ziyaretçilerimize sunulan hizmetlerin geliştirilmesi, yeni özelliklerin getirilmesi, bu özelliklerin ziyaretçilerimizin tercihlerine göre kişiselleştirilmesi ve internet sitemiz ile ziyaretçilerimizin hukuki ve ticari güvenliğinin sağlanması amacıyla kullanıyoruz. Birçok internet tarayıcısı, varsayılan olarak çerezleri otomatik olarak kabul etmeye ayarlıdır. Eğer bu araçların kullanılmasını istemiyorsanız, tarayıcı ayarlarından silebilir veya engelleyebilirsiniz. 5. Kişisel Verilerin İşlenme Amaçları
KVKK uyarınca kişisel veriler, kural olarak ilgili kişinin açık rızası bulunmaksızın işlenememektedir. Kişisel verileriniz; 4.maddede yer alan yöntemlerle Firmamız tarafından, mevzuatın izin verdiği durumlarda ve ölçüde kişisel bilgilerinizi işlemektedir. Bu çerçevede, kişisel verilerinizin işlenme amaçları aşağıdaki gibidir:
● Platformlarımız üzerinden bilet alan ve adına bilet alınan yapılan kişinin kimlik bilgilerini teyit etmek,
● İletişim için adres ve diğer gerekli bilgileri kaydetmek,
● Sözleşme kurulması ve ifasına yönelik süreçlerin yürütülmesi,
● Mesafeli Satış Sözleşmesi ve Tüketicinin Korunması Hakkında Kanun’un ilgili maddeleri tahtında akdettiğimiz sözleşmelerin koşulları, güncel durumu ve güncellemeler ile ilgili müşterilerimiz ile iletişime geçmek, gerekli bilgilendirmeleri yapabilmek, akdettiğimiz sözleşmeler uyarınca üstlenilen yükümlülükleri ifa etmek,
● Elektronik veya kâğıt ortamında işleme dayanak olacak tüm kayıt ve belgeleri düzenlemek,
● Kamu güvenliğine ilişkin hususlarda talep halinde ve mevzuat gereği kamu görevlilerine bilgi verebilmek,
● Müşterilerimize daha iyi bir hizmet sağlamak, müşterilerimizin ilgi alanlarını dikkate alarak müşterilerimizin ilgilenebileceği ürünlerimiz hakkında müşterilerimize bilgi verebilmek, kampanyaları aktarmak,
● Elektronik Ticaretin Düzenlenmesi Hakkında Kanun ve ilgili mevzuat çerçevesinde müşterilerimize e-posta veya kısa mesaj yoluyla bilgi vermek,
● Müşteri memnuniyetini artırmak, Platformlarımızdan müşterilerimizi tanıyabilmek ve müşteri çevresi analizinde kullanabilmek, çeşitli pazarlama ve reklam faaliyetlerinde kullanabilmek ve bu kapsamda anlaşmalı kuruluşlar aracılığıyla elektronik ortamda ve/veya fiziki ortamda anketler düzenlemek,
● Anlaşmalı kurumlarımız ve çözüm ortaklarımız tarafından müşterilerimize öneri sunabilmek, hizmetlerimizle ilgili müşterilerimizi bilgilendirebilmek,
● Hizmetlerimiz ile ilgili müşteri şikâyet ve önerilerini değerlendirebilmek,
● Mal, hizmet üretim, operasyon ve satış süreçlerini, finans ve muhasebe faaliyetleri ile arşiv faaliyetlerini yürütmek,
● Bilgi güvenliğini sağlamak,
● Yasal yükümlülüklerimizi yerine getirebilmek ve yürürlükteki mevzuattan doğan haklarımızı kullanabilmek amaçlarıyla ancak KVKK düzenlenmelerine uygun olarak işlenmektedir.
3. İşlenen Kişisel Verileriniz
İşlenen kişisel verileriniz, Firmamız ile kurmuş olduğunuz hukuki ilişkinin niteliğine göre değişiklik gösterebilir. Bununla birlikte, genel itibariyle işlediğimiz kişisel veriler aşağıdaki gibidir:
Kimlik Bilgisi Platform’a üye olurken, Platform üzerinden veya fiziki acentelerimizden bilet ararken, satın alırken, rezervasyon yaparken ve benzeri hizmetlerde, canlı destek veya çağrı merkezi üzerinden yapılan görüşmelerde ve her türlü başvurunuzda sağlamış olduğunuz ad, soyadı, kimlik bilgileri, doğum tarihi, ehliyet bilgileri, pasaport numarası, uyruk vb. kişisel verileriniz.
İletişim Bilgisi Platform’a üye olurken, Platform üzerinden veya fiziki acentelerimizden bilet ararken, satın alırken, rezervasyon yaparken ve benzeri hizmetlerde, canlı destek veya çağrı merkezi üzerinden yapılan görüşmelerde ve her türlü başvurunuzda sağlamış olduğunuz e-posta adresi, telefon numarası, cep telefonu numarası, sosyal medya iletişim bilgileri, adres vb. kişisel verileriniz.
Müşteri Bilgileri Ad, soyadı, uyruk, doğum tarihi, T.C. kimlik numarası, pasaport numarası, cinsiyet, rezervasyon bilgileri, satın alma bilgileri, fatura bilgileri, teslimat bilgileri, seyahat bilgileri, seyahat tarihleri, müşteri işlem bilgileri; API/PNR numaraları; çağrı merkezi kayıtları, kredi kartı ekstresi, gişe dekontları, müşteri talimatları, buna yönelik kanallarda kaydedilen kayıtlar vb. kişisel verileriniz, talep ve şikayetler kapsamında toplanan bilgiler ve kayıtlar ile bunların sonuçları ile dijital ortamlarda sunulan hizmetlerimizden faydalandığınız sırada oluşturduğunuz internet sitesi şifre ve parola bilgileri.
Finansal Bilgiler Kredi/banka kartı bilgisi, banka hesabı bilgisi, IBAN bilgisi, bakiye bilgileri, alacak bakiyesi ve diğer finansal bilgileri.
Hassas Veriler Mevzuatta açıkça öngörülen ve operasyonlarımız için gerekli olduğu hallerde ve açık rızanız üzerine işlenen aldığınız hizmeti etkileyebilecek olan sağlık durumunuza ilişkin gerekli bilgiler, engellilik bilgisi.
Pazarlama Bilgileri Pazarlama amacıyla kullanılacak kişinin beğenilerini gösteren raporlar, hedefleme bilgileri, çerez kayıtları, veri zenginleştirme faaliyetleri ile türetilen bilgiler, anketler, kampanyalar ve doğrudan pazarlama çalışmaları neticesinde elde edilen bilgiler ve değerlendirmeler.

Diğer Bilgiler Aile bireyleri ve yakın bilgisi (ilgili kişilerin çocukları, eşleri ile ilgili kimlik bilgisi, iletişim bilgisi), fiziksel mekân güvenlik bilgisi (giriş/çıkış kayıtları, ziyaret bilgileri, fotoğraflar, kamera ve ses kayıtları), hukuki işlem ve uyum bilgisi (adli ve idari mercilerden gelen bilgi talepleri vb.).
5. Firmamızın Kanun’dan Doğan Hak ve Yükümlülükleri
Şirketimiz tarafından kişisel veriler, Anayasa’nın 20. maddesine ve KVKK’nın 4. maddesine uygun olarak;
● Hukuka ve dürüstlük kurallarına uygun,
● Doğru ve güncel olarak,
● Belirli, açık ve meşru amaçlar güderek,
● İşleme amaçlarıyla bağlantılı,
● Sınırlı ve ölçülü bir biçimde
kanunlarda öngörülen veya kişisel veri işleme amacının gerektirdiği süre kadar muhafaza edilmek suretiyle, KVKK’nın 5. ve 6. maddesinde belirtilen şartlara dayanarak işlenmektedir ve aktarılmaktadır.
● Platform üzerinden alınan bütün veriler TLS 1.2 standardı uyumlu 256 bit RSA SSL sertifikası ile bilgisayarınızdan veya mobil cihazınızdan uygulama sunucularımıza aktarılmaktadır. Uygulamamız sunucularında ödeme bilgileriniz yasalara uygun şekilde veritabanında tutulmaktadır.
● Belirli aralıklarda sızma testleri uygulanmakta ve sistemin yetkisiz erişimlere dayanıklılığı test edilmektedir.
● Platform’dan toplanan kişisel verilerin hukuka aykırı olarak işlenmemesi için çalışanlara yönelik erişim yetki ve kontrol matrisleri oluşturulmuştur.

KVKK’nın 4. maddesi uyarınca firmamızın ilgili kişilerin kişisel verilerini doğru ve güncel olarak tutma yükümlülüğü bulunduğundan, bu yükümlülüklerini yerine getirebilmesi için müşterilerimizin bizler ile doğru ve güncel verilerini paylaşması gerekmektedir. Kişisel verilerinizin herhangi bir surette değişikliğe uğraması halinde profil sayfanızı ziyaret ederek bilgilerinizi güncellemeniz gerektiğini belirtmek isteriz.
Platform Sahibi, işlediği kişisel verileri mevzuatla belirlenen sürelerde saklamakta olup mevzuatta ayrıca süre belirlenmemiş olması halinde; kişisel veriler ilgili kişisel veriyi işlerken sunduğumuz hizmetlerle bağlı olarak firmamızın uygulamaları ve ticari yaşamının teamülleri uyarınca işlenmesini gerektiren süre kadar ve bu süreden sonra sadece olası hukuki uyuşmazlıklarda delil teşkil etmesi amacıyla uygulamada gerekliliği ortaya konulan süreler boyunca saklanmaktadır. Belirtilen sürelerin sona ermesinden sonra söz konusu kişisel veriler silinmekte, yok edilmekte veya anonim hale getirilmektedir.
6. Kişisel Verilerin Aktarılması
Kişisel verilerin üçüncü kişilerle paylaşımı, yürürlükteki mevzuat ve/veya ilgili kişilerin verdiği açık rıza çerçevesinde gerçekleşmektedir. Bununla birlikte, yasal yükümlülüklerimiz nedeniyle ve bunlarla sınırlı olmak üzere mahkemeler ve diğer kamu kurumları ile kişisel veriler paylaşılmaktadır. Ayrıca, taahhüt ettiğimiz hizmetleri sağlayabilmek ve verilen hizmetlerin kalite kontrolünü yapabilmek için bir sözleşme ilişkisi çerçevesinde üçüncü kişilere kişisel veri aktarımı yapılmaktadır.
Üçüncü kişilere veri aktarımı sırasında veri ihlallerini önlemek için gerekli teknik ve idari önlemler alınmaktadır.
Kişisel verileriniz, faaliyetlerimizi yürütebilmek için işbirliği yaptığımız program ortağı kurum, kuruluşlarla, yetkili acentelerle, hizmet sağlayıcı ve/veya aracı hizmet sağlayıcı sıfatını haiz üçüncü kişilerle, özel entegratör hizmeti veren iş ortaklarımızla, bağımsız denetim veren üçüncü kişilerle, verilerin bulut ortamında saklanması hizmeti aldığımız yurt içi/yurt dışı kişi ve kurumlarla, müşterilerimize ticari elektronik iletilerin gönderilmesi konusunda anlaşmalı olduğumuz yurt içi/yurt dışındaki kuruluşlarla, mali müşavirlerimizle, Bankalararası Kart Merkeziyle, anlaşmalı olduğumuz bankalarla, ödeme hizmeti sağlayan kuruluşlarla ve sizlere daha iyi hizmet sunabilmek ve müşteri memnuniyetini sağlayabilmek için çeşitli pazarlama faaliyetleri kapsamında yurt içi ve yurt dışındaki çeşitli ajans, reklam şirketleri ve anket şirketleriyle ve yurt içi/yurt dışı diğer üçüncü kişilerle ve ilgili iş ortaklarımızla, hissedarlarımızla ve iştiraklerimizle ve de bir sözleşme ilişkisi kapsamında hizmet aldığımız üçüncü kişilerle, avukatlarımızla, danışmanlarımızla ve kanunen yetkili kamu kurum ve özel hukuk tüzel kişileriyle paylaşılabilmektedir.
7. İlgili Kişinin Hakları
Kişisel veri sahipleri KVKK’nın 11. maddesi uyarınca;
1-Kişisel veri işlenip işlenmediğini öğrenme,
2- Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
3-Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
4-Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
5-Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme,
6-Kanun’un 7. maddesinde öngörülen şartlar çerçevesinde kişisel verilerin silinmesini veya yok edilmesini isteme,
7-5. ve 6. maddeler uyarınca yapılan işlemlerin, kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
8-İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
9-Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme, haklarına sahiptir.
Söz konusu hakların kullanılması için KVKK’nın 13. maddesi doğrultusunda, kişisel veri sahipleri tarafından Firmamıza yazılı olarak veya Kişisel Verileri Koruma Kurulu tarafından belirlenecek diğer yöntemlerle başvurulması halinde, başvurular talebin niteliğine göre en kısa zamanda ancak her halükârda en geç 30 gün içerisinde sonuçlandırılır. KVKK’dan doğan haklarınızı kullanmak için, kimlik, adres ve iletişim bilgilerinizi, kullanmak istediğiniz hakkı ve talebinizin konusunu anlatan detaylı açıklamanızı imzalı şekilde aşağıda yazılı adres ve iletişim bilgilerine iletebilirsiniz.
